Clients agree to provide accurate information, materials, and access required for Kinesis to perform its services.Clients are responsible for providing timely feedback, approvals, and any assets required for project completion.Failure to provide necessary materials or communication may delay project timelines and does not constitute a breach of service by Kinesis.
3. Payments
All services provided by Kinesis are subject to agreed-upon pricing before work begins. Payments may be structured as project-based fees, monthly retainers, or other mutually agreed arrangements. Payments are due according to the terms outlined in the client agreement or invoice. Late payments may result in suspension of services until payment is received. All payments made to Kinesis are non-refundable once work has begun unless otherwise agreed in writing.
4. Intellectual Property
Upon full payment for services rendered, clients receive rights to the final deliverables created for their brand.Kinesis retains the right to display completed work, including designs, creative assets, and project results, in portfolios, marketing materials, and case studies. Any third-party tools, software, or licensed assets used in projects remain subject to their respective licenses.
5. No Guarantee of Results
While Kinesis aims to improve brand performance, positioning, and marketing effectiveness, we do not guarantee specific financial results, revenue growth, or advertising performance. Business outcomes depend on many factors including product quality, market demand, competition, and execution by the client.
6. Confidentiality
Kinesis respects the confidentiality of client information. Any sensitive materials shared during projects will be handled responsibly and will not be publicly disclosed without permission. However, general project information and non-sensitive materials may be used for portfolio and marketing purposes unless otherwise agreed.
7. Limitation of Liability
To the fullest extent permitted by law, Kinesis shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our services or website. Our total liability in connection with any claim shall not exceed the amount paid by the client for the specific service in question.
8. Termination
Kinesis reserves the right to terminate services if a client violates these Terms, engages in unlawful activity, or fails to meet payment obligations.Clients may terminate services according to the terms specified in their service agreement.
